Terms of Service

This website (the “Site”) is owned and operated by Tall City Exteriors (“we,” “us,” or “our”), a fence contractor based in Midland, Texas. By using the Site you agree to these Terms, to our Privacy Policy, and to any additional terms we give you in a written estimate or contract. If you do not agree, please do not use the Site.

We may update these Terms from time to time. The current version will always be posted here with its effective date. Using the Site after a change means you accept the updated Terms.

What the Site Is For

The Site describes our fence building, repair, staining and exterior painting services and lets you request a free estimate, contact us, or sign up for occasional updates. You agree to use the Site only for lawful purposes. You may not scrape, overload, disable or interfere with the Site, submit false or misleading estimate requests, or try to access any system or account that is not yours.

Estimates and Job Contracts

Requesting an estimate through the Site does not create a contract. An estimate becomes a job only when we provide a written quote and you accept it. The quote, and any contract that follows it, control the scope, price, schedule, materials and payment terms of the work, and they take priority over anything on the Site if the two conflict.

Prices, timelines and descriptions on the Site are general and may change without notice. Fence pricing depends on length, height, material, terrain, gates, tear-out and site access, so the only binding price is the one in your written quote. We may decline or cancel an estimate request for any reason, including availability, errors or suspected fraud.

You are responsible for giving us accurate contact and property information, for confirming that you own the property or have the owner’s permission, and for telling us about property lines, easements, HOA rules, underground utilities you know of, pets, and anything else that affects the work.

Payments, Deposits and Refunds

Payment terms, deposits and cancellation terms are set out in your written quote or contract. Unless that document says otherwise, deposits cover materials ordered for your job and are not refundable once materials have been purchased. Any payments made through links or tools on the Site are handled by our payment processor under its own terms. Questions about a specific payment go to at alex@tallcityexteriors.com.

Warranty

Our workmanship warranty, if any, is stated in your written quote or contract. Nothing on the Site creates or extends a warranty. Wood is a natural product and will move, check and weather; stain fades with sun exposure; and fences can be damaged by wind, vehicles, livestock, soil movement and water. None of those are workmanship defects.

Content You Send Us

If you send us photos, measurements, reviews, testimonials or other material through the Site, by text or by email, you confirm you have the right to share it. You give us permission to use it to prepare your estimate, do the work and, for reviews and testimonials, in our marketing. We handle it as described in our Privacy Policy.

Photos of finished work. We may photograph fences we build, repair or stain and use those photos on our website, social media and advertising. We will not show your name, house number or street without asking you first. Tell us in writing if you do not want your project photographed.

Our Content

Everything on the Site, including text, photos, logos and design, belongs to Tall City Exteriors or its licensors and is protected by copyright and trademark law. You may view, print or save pages for your own personal use. You may not copy, republish, sell or use our photos or text for any other purpose without written permission from us.

Disclaimers

The Site is provided “as is.” We do not promise that it will be error-free, uninterrupted or current. Any links to other websites, such as review platforms or material suppliers, are provided for convenience and we are not responsible for their content. Information on the Site about fence types, materials, maintenance or permits is general guidance, not a guarantee about your property or project.

Limitation of Liability

To the fullest extent Texas law allows, Tall City Exteriors and its owners, employees and subcontractors are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim related to the Site is limited to one hundred dollars ($100). This section applies to the Site only. Liability for fence work we perform is governed by your written contract and applicable law.

Indemnification

You agree to defend and hold harmless Tall City Exteriors, its owners, employees and subcontractors from claims, damages and costs, including reasonable attorneys’ fees, arising from your misuse of the Site, your violation of these Terms, or any false information you give us about yourself or the property.

Termination

We may block or suspend your access to the Site at any time if we believe you have violated these Terms or used the Site in a way that is harmful or unlawful.

Governing Law and Disputes

These Terms are governed by the laws of the State of Texas. Any dispute about the Site will be brought in the state or federal courts located in Midland County, Texas, and you agree to that venue.
